1. 1

Jurisprudence is the study of law as a subject — the thinking about what law is, where it comes from, and how it should work. It is not one court case, and it is not the power of a court (that is jurisdiction).

Jurisprudence is the study of law as a subjectjurisprudence是把法律當成一門學問來研究 — the thinking about what law is也就是去思考法律到底是什麼, where it comes from它從哪裡來, and how it should work以及它該怎麼運作. It is not one court case它不是指某一個法庭案件, and it is not the power of a court也不是指法院的權力 (that is jurisdiction那個叫jurisdiction).

A class in jurisprudence asks slow questions: Why do we have laws? What makes a law fair?

A class in jurisprudence一堂jurisprudence的課 asks slow questions會問一些需要慢慢想的問題: Why do we have laws我們為什麼需要法律? What makes a law fair什麼樣的法律才算公平?

You meet the word at university and in serious books, almost never in street talk. It feels very formal.

You meet the word at university你會在大學裡碰到這個字 and in serious books以及嚴肅的書籍裡, almost never in street talk但幾乎不會出現在日常街談裡. It feels very formal它給人的感覺非常正式.

Though actually, the second half looks like English (being careful), and that is not an accident: the Latin piece meant practical wisdom, skill at the law. Still, in modern English you should not hear “jurisprudence” and think “careful behaviour.” Think “the science of law.”

Though actually不過實際上, the second half looks like English prudence後半段的拼法看起來很像英文的prudence (being careful也就是「謹慎」), and that is not an accident這不是巧合: the Latin piece meant practical wisdom拉丁字源的意思是實用的智慧, skill at the law也就是對法律的精通. Still不過, in modern English在現代英文裡, you should not hear 'jurisprudence' and think 'careful behaviour.'你不該聽到『jurisprudence』就想成『謹慎的行為』 Think 'the science of law.'要想成『法律這門學問』.
